In 2017, improvements to The Death on High Seas Act, also known as DOHSA, were proposed by Congress. These proposed improvements would govern the safety and security of passengers on cruise ships, as well as allow companies to be held accountable by a maritime accident attorney for deaths of passengers or employees while at sea.

Why Were the Changes Proposed?

Changes to DOHSA were proposed because of current limitations to maritime law that prevent cruise ship companies from being held accountable for negligence causing employee or passenger deaths while at sea, and which prevent families from receiving a financial settlement as a result.

Family members are currently prohibited from recovering damages for mental anguish and pain and suffering when a loved one dies in international waters. The proposed changes would allow for the opportunity to seek full recovery for emotional damages.

Getting the Right Legal Representation for Maritime Incidents

Although the above amendments have not yet been implemented, it’s important to know that you can still recover damages under DOHSA or under the Jones Act if you are a maritime worker who has been injured on the vessel or ship on which you worked.

When seeking compensation for the death of a loved one or an injury while at sea, the right representation is absolutely critical. The best maritime accident lawyer for you will be one who understands the financial and other difficulties families encounter when wages are lost.

An attorney experienced in maritime injury law will not only strive to get clients as much compensation as possible, but will also help families recover information about their loved one’s condition and whereabouts.
